TERMS OF SALE

PLEASE NOTE:  	ALL BIDDERS AND OTHERS ATTENDING THIS AUCTION SHOULD READ 
		AND FULLY UNDERSTAND THE FOLLOWING TERMS.  

1)   Cash, Cashier’s Check or Bank Letter of Credit must accompany all checks.  
     All bills must be paid in full immediately following the sale. 

2)   Sales taxes will be added to the purchase price unless buyer is tax exempt 
     and presented us with a current sales tax certificate. 

3)   Any announcements at the auction take precedence over all printed matter.
 
4)   Auctioneer will receive bids from any responsible and registered bidder. 

5)   Auctioneer has the right to refuse any bid for whatever reason he deems 
     necessary.  Auctioneer will settle any bidder dispute by reselling the lot. 

6)   All items are sold as is, where is, with all faults.  All items should be 
     examined in person prior to bidding.  Descriptions of items appearing in
     prior advertising are believed to be correct.  Mathesons’ AA Auctions tries 
     to provide the most accurate description of each item; however, descriptions
     or any oral statements made by auctioneer or his agents or officers
     concerning any item shall not be construed as a warranty, either expressed 
     or implied.  Your bidding will signify that you have examined the merchandise
     and accept it as is.   We recommend prospective bidders examine all items in
     which they have an interest.  

7)   If you require absolute certainty in all areas of authenticity, and the 
     results of your evaluation leave uncertainty in your mind, we recommend you
     not bid on the item in question.
 
8)   Written and oral descriptions are our opinions and should in no way be 
     construed as a guarantee of any kind as to age, condition, materials or any
     other feature of the items being sold.
 
9)   No statements written or oral made by the auctioneer shall be deemed as 
     warranty or assumption of liability by Matheson’s AA Auctions or by any 
     seller represented by Mathesons’ AA Auctions.
 
10)  The winning bidder becomes the owner of the item immediately at the close of
     the bid.  The Auctioneer is not responsible for error.  All sales are final.
 
11)  Please determine condition, genuineness and/or authenticity BEFORE you bid as
     all items are sold “As Is”  “Where Is”  however; at the same time if it comes
     to our attention before the auction, either through our continuing research 
     or through the research of an expert on a particular item that it is not a 
     genuine example, or that a painting is not by the artist whose signature it 
     bears, then the item shall be withdrawn from the sale.
